In registering to use the Website, owned and managed by Council, I agree that such use will be in accordance with the Terms and Conditions outlined below.

1. Privacy The following statement applies to the collection, use, disclosure and handling of personal information collected by Council via our Website. As a NSW government agency, Council must meet the requirements of the Privacy and Personal Information Protection Act 1998 (Cth) and the Government Information (Public Access) Act 2009 (NSW). It is acknowledged that the Website’s primary purpose includes, but is not limited to, viewing information on the Singleton LGA, submitting a local job or applying for a local job, submitting a business directory listing or a Australian Tourism Data Warehouse Listing, subscribing to a newsletter and submitting an enquiry and accordingly any personally identifiable information provided via the Website is governed in accordance with Privacy and Personal Information Protection Act 1998 (Cth) and the Government Information (Public Access) Act 2009 (NSW) and may be requested by a third party.

2. Website Services The Website is an Investment Attraction website featuring information and services related to users looking to live, work, play and invest in Singleton LGA. The Website features the following interactive services and terms:

    • A jobs board for employers to list local job opportunities and for local job seekers to send their resume to these employers.
      • The Jobs Board is available to employers located in or servicing the Singleton LGA.
      • Job seekers may apply for listed roles directly via contact details provided or links to third-party platforms.
      • Council will approve the job listing for publication. It is not responsible for the content of job advertisements or recruitment outcomes. o Users are responsible for the accuracy and legality of the information they submit.
      • Council reserves the right to edit, update or remove job listings at its discretion.
    • A business directory, categorised by industry, allows local businesses to upload a profile/listing on the directory.
      • Listings in the Business Directory are user submitted.
      • Council will approve the business listing for publication. It is not responsible for the information submitted by the business.
      • Only businesses registered or with a trading office within the Singleton LGA are eligible to be featured in this business directory.
      • Council reserves the right to edit, update or remove business directory listings at its discretion.
    • A visitor directory will be populated by content from the Australian Tourism Data Warehouse.
      • Council holds an authorised licence to distribute content from the Australian Tourism Data Warehouse, via the Website. All Australian Tourism Data Warehouse source data is subject to the Australian Tourism Data Warehouse distributor agreement terms.
      • Council is not responsible for the content of an Australian Tourism Data Warehouse listing featured on the Website .
      • The Website will only feature visitor and tourism businesses that are registered or trading within the Singleton LGA.
      • Council reserves the right to edit, update or remove visitor directory listings at its discretion.
    • An events directory will be populated by content from the Australian Tourism Data Warehouse.
      • Council holds an authorised licence to distribute content from the Australian Tourism Data Warehouse, via the Website. All Australian Tourism Data Warehouse source data is subject to the Australian Tourism Data Warehouse distributor agreement terms.
      • Council is not responsible for the content of an Australian Tourism Data Warehouse listing featured on the Website.
      • The Website will only feature events held in the Singleton LGA by organisations or businesses that are registered or operate in the Singleton LGA. Events must meet the Australian Tourism Data Warehouse event guidelines. They must also attract at least 100 attendees. (NB: this could be changed to reflect the new Singleton Council Events Promotion Policy guidelines that are currently in development once this is adopted)
      • Council reserves the right to edit, update or remove events listings at its discretion.

3. Copyright and Licence Website Terms The Website may contain information, data, graphics, images and other materials (Content) prepared for and on behalf of Council.

Council Content The Content is subject to copyright under the Copyright Act 1968 (Cth) and other countries through international treaties.

Licence Council grants you a non-exclusive licence to produce the Content of the Website in your web browser (and in cache files produced by your web browser) for the sole purpose of viewing the Content however reserves all other rights. If you copy, reproduce, republish, upload to a third party, transmit or distribute in any way the Content of this Website contrary to the provisions of the Copyright Act 1968 (Cth) you will be taken to have indemnified Council against any claim or action in respect to breach of copyright.

Content in the visitor and events directory is subject to the terms of the Australian Tourism Data Warehouse distributor licence and copyright.

4. Your Content, Use of Content and Liability

Your Content You are responsible for the supplied Content included in any communications that you submit to this Website or otherwise to Council, including its truthfulness and accuracy. You acknowledge that, where you submit any Content to or via this Website, any statement made by you accurately sets out the evidence which you would be prepared, if necessary, to give in court as a witness. Any such statement must be true to the best of your knowledge and belief and you make it knowing that, if it is tendered in evidence, you shall be liable to prosecution if you have wilfully stated in it anything which you know to be false, or do not believe to be true. You must ensure that any supplied Content that you submit to the Website is not offensive, indecent, discriminatory, abusive, harassing or pornographic and does not infringe the rights, including intellectual property rights such as copyright, of any person.

You acknowledge that the supplied Content and format of the Website may be changed by Council at any time, without notice, in its absolute discretion.

Liability – No Representation Council will not be liable for any loss, liability, damages or injury (including without limitation, indirect, special or consequential loss) resulting from your access to, or inability to access, the Website or any Services associated with it, from your reliance on any supplied Content provided on the Website or from your submission of any Content to the Website. In addition, Council makes no representations, warranties or assurances as to the accuracy, currency or completeness of the Website’s Content or the availability of services provided via the Website. Council is not the owner of any rating information accessed in relation to any property details within the Website; such information is provided to Council by means of a third party for property rating purposes.

5. Third Party Sites The Website may provide links or references to other independent third party sites however Council is not responsible for the supplied Content of such other sites and will not be liable for any damages or injury (including without limitation, indirect, special or consequential loss) arising from that Content. Any links to other sites are provided as merely a convenience to Website users.

6. Laws The Website is intended for use by residents of Australia only and the Content is governed by the laws in force in New South Wales and, if appropriate, Commonwealth legislation.
